    who cares what speed he was going, that has nothing to do with it, the guy turned into him, thats all there is to it!!!!!

      Signalling is just the intent to change lanes or turn not giving you the right to just change lanes reguardless of whether someone is there or not. I bet he was actually sholder checking and turned into you becuase he was looking back, mention that to the police.

        That sucks, Yuval - sorry to hear.

        I definitely recommend you sit down and write out exactly what happened - all the details.

        When: time and date
        Where: closest interestion
        Direction: note the direction of all cars involved
        Speeds: if you were passing him, etc
        Witnesses: if there are any - their contact info so the police can contact them and ask them to come down and fill out a police report.

        Anything you can think of.

        And draw a diagram, too.

        Then take that information, along with all the contact info (drivers licence, insurance, registration) of both yourself and the other driver to the police station.

        If you have witnesses ask them to also file a police report. (The police will call them anyways, if you list them as a witness.)

        If you have a dent in your rear panel there's a very good chance it'll be over $1000. Painting alone is usually what does you in.

        Bottom line - get everything down now while it's fresh. And review it a couple times to make sure your intent is accurately expressed. Then when you get to the police station just re-write it. For me it's less stressful that way when I get there.

        You can also get a couple repair quotes before you decide if you need to involve the cops. But write everything down NOW, I can't stress that enough. If you need to file a police report later at least you'll be prepared.

          Man, I am sorry to hear what happened.

          I agree that if you are in a situation where this happens you should IMMEDIATELY file a police report. I have even had other people admit an accident was their fault at the scene, then later hear that they filed a report for police/insurance that was different.

              Thanks for your support everyone. I have already taken it to the bodyshop to get an estimate (above $1000 as suspected) and I have also filed a police report, where I was very clear about what happened and that he was behind and to the right of me the whole time. To the person who suggested I was speeding, I was actually doing about 40kph at the time. The other driver simply wasn't paying attention. I'm hoping for the best.

                  Wow, I've been waiting for this to happen to me.....with the high ratio of crap drivers in calgary, I'm shocked I haven't been hit.....Sorry to hear!

                      Word . . . I had a lady try and pull that one on me a few years back. I was doing about 35 km/h along a busy city street when she turned into me. She claimed it wasn't her fault because she signalled. Here's the thing - she was parked in front of a bus stop and, when she saw a bus on the way, she panicked. God . . . there were pieces of Korea everywhere, but my MkII only needed a headlight, blinker, bumper cover, and allignment. She agreed to pay for the damages while apoligizing profusely just to keep the insurers out of it (she had none). Her Accent limped off and all was well.

                      Cool . . . until she stopped taking my phone calls and disappeared.

                      She said that she spoke with a lawyer who told her I was at fault for not yielding. Luckily there were plenty of eye-witnesses whose phone #'s i took down, so, when i sued her uninsured ass, it was a walk over (I also took many photos). Oh, and I'm not sure what happened to her 'lawyer'. Without the eye-witnesses and pictures, i would have been sunk because I didn't file a police report right away.

                      It's frustrating enough to have somebody else damage your vehicle without having them contest the accident when it's obviously their fault. It would really help your cause if you had an eye-witness or had a passenger with you at the time. Good luck and remember - CYA (Cover Your A$$).
