    Re: Backed into in Drive-thru

What ever you do don't take any BS from your Melloshe agent. I have had some very bad experience with them in the past.

      Point Noted.

Anyone think I should go talk to the pigs and file a report? It's a pain in the ass.

        Re: Backed into in Drive-thru

One thing I am dealing with now with my claim...
Most insurance companies have a maximum amount that they will allow for charged hourly rates.. All-State has told me $68 is about the max.. Cosmos charges $75.
However.. Cosmos is currently doing a car for AllState at that 75 rate.. so it sounds like there is a bit of movement.

I know everyone is worried about their car being taken out for a spin... but at a shop like Cosmos.. your GTI (no offense) would be at the lower end of the list to take out.

If the damage is over 1k.. you HAVE to have a Police report before anyone will touch it. Just being a bumper and paint.. you should be ok

Thanks for the info, Because frankly I find the anyone in the CPS that I have dealt with, Quite condescending.

To hell with it, Really, you could just replace the grill and never know the difference, and there would be nothing on the vehicle history as well, but I'll know the difference.

Should have told the guy $1000 cash, and call it square!

              Re: Backed into in Drive-thru

I know my girlfriend's father had an issue where in Edmonton someone side swiped his car. He had driver side rear quarter panel damage, as well as damage on the passenger side front from the impact. He went to report it to CPS and they said since there was no way of proving the two happened at the same time, he would have to claim them as separate incidents. Although the person helping him went the extra mile and tried to help as much as possible. Instead of having to go all the way to Edmonton to report it, in writing it just happened sometime in the recent past. Which may have occurred in Edmonton.

                Re: Backed into in Drive-thru

I can confirm that most insurance companies are reluctant to pay Cosmos Collision's rates. Loc at Cosmos will tell you as much, in fact he usually wants a letter from your insurer stating that they are willing to pick up 100% of the repair costs before he will start work.

As for the insurance, all you need is for the guy who backed into you to admit he indeed backed into you. If he does you're fine. There are rules that apply to parking lots as well, not all accidents are 50/50. For instance the right of way rule applies. And if you are backing up you are generally responsible for all damages if you hit another vehicle unless they are also backing up or are driving wrecklessly and you have an independant witness to prove it.

I filed a police report yesterday. I'll call my agent today and see if the guy admited fault. Hopefully he did, and it's simple, if not......

Thats what I was worried about..... in all reality there isnt any proof besides your word that he backed into you, however there is proof that you rear ended him. Luckily the guy that backed into me was honest and upfront...

That statement is what worries me,don't be surprised if he charges you.

Do you have a pic of the incident?and a written statement.

That's the thing that worries me. I'm trying to get ahold of the security footage at the Gas Station where the Tims Drive-thru is. I'm hoping he is a honest guy, but my gut feeling says this isn't going to go smoothly.

accidents where the car is in reverse are 100% at fault to the person in reverse.
all other accidents in parking lots are 50/50.

I don't understand how this can be true, what if I am in the Drive-thru and some guy drives into the back of my car?
