  • Dealer Threatens Buyer for NOT Buying car

    I have cancelled a sale on a used 2001 Jetta and the dealer said my $500 deposit is gone and I will never see it, item 6 on the sales agreement says that if the sale is cancelled the buyer will get the money or the trade in back. The best part is that he threatened to sue me for a lost sale and that he will see me in court. He said I will have to pay them the $16,000. I submitted a complaint with AMVIC. I wish some people would make sure the brain is on before engaging the mouth. The car was $16,000 and the interest was $13,000. I went shopping for a better rate and Northland VW got me a better deal. Northland got me in to a used 2002 Jetta GLS for a lower monthly payment and a 3 year warranty. I will see all the details on Thursday for now it is all the second hand information over the phone. Mean while I will be waiting for the subpoena to show up.

    yea he can do jack to you for not buying the car but your deposit they can take i'm pretty sure.. i could be wrong tho

      If that happened to me, I would go down there, stand on the curb and politely tell every customer who arrived what happened, at least for a couple weekends.

          The sale was based on approval of financing, I did not approve of the financing. They did not get my signature on any of the documents but they cashed the cheque before I signed the bill of sale. They need to wait for the bill of sale to be signed before the sale is final. The whole deal was a comedy of errors. These guys were not very professional. I did most of the preliminary paperwork because they could not get it right. It was a flurry of faxes and emails before they got a quote together. The unit was in the Autotrader for $15,500 first bill of sale said it was $16,300 then I complained and they said that was the price ($16,300).

          It was a nice ride it had some mods but I know it would have been a hassle dealing with them after I bought the car.

          The big kick in the a$$ is that my wife said it did not "feel" right, dam women and there "feelings" They could use a lesson in customer service. It would have been better to say sorry it did not work out and better luck next time, than to threaten a customer. They (the customer) could start a thread on a car forum about the poor service or something.

            Wow, where was this at if I can ask?? Thats a sour deal all around, I wouldn't have stood for it at all...the buyer is in charge, if you don't want it, too bad for them!

                I can't see it geing 5th ave as Dereck is the finace manager (I believe) and is a very stand up guy and if you went to northlands after that leaves only one place....

                  It was Auto Fleet Sales, they are tied in with Bonnie Brook Auto Sales some how. They are on Ogden Rd. They have quite a few (6) VW Jettas there. It is just a small lot. I thought I was saving a couple grand as the price was good, compaired to the other lots. But Northland treats a person with respect even though the prices are higher, I don't feel like they are trying to screw me over.

                      Your bank can reverse a cheque for a small fee I think? Then it would be after them to come after you if they thought that they deserve the money and have a legitimate case. Assuming they have a lawyer, they will probably decide its not worth it if they do not have a signature etc.

                        They cannot keep a deposit, unless you signed something saying it's forfeit. Any place with that kind of interest is a shark operation (our old receptionist was getting 42% interest rate on a truck. Note the lack of decimal). Don't wuss out and keep demanding it back or you'll sue them!

                        You could also ask NL for some advice - often a big dealer who's getting the sale might be willing to make a call or at least tell you how it works.

                          I used to have a business and as a business person you need to be diplomatic and not run off at the mouth. The sales slip he signed explains it all on the back saying the customer gets the deposit back if the deal is cancelled. It is in black and white (well really it is pink and grey ) I just have to talk to some one in the company that is not so quick to run off at the mouth. And if they resolve the issue quickly I will post here that it is fixed.

                            Well it is good to hear it wasn't a dealership. We know they only steal our money when we take out cars in for service or parts
