    In my opinion they should not be able to deny a claim if you are lowered and are still at the legal height stated in the Traffic Safety Act. Best of luck lance!

      i think it sucks that your car was damaged but i'm gonna have to agree that it shouldn't be covered. i think the city takes a harsh stand on this and i don't blame them. i imagine the floodgate of clams vs. pay outs would be through the roof and i wouldn't want to be paying for that, as a taxpayer. since everyone is commenting on the car being lowered, yet still within the TSA, what about those raised trucks who still fall into that legal category who get stuck under a low bridge? should we pay for those guys too? the city would even be aware of said low bridge and then should be liable, right? wrong. i'm of the opinion that if you modify your car in any way, you give up any rights you have in regards to driving around on any roads.

      but i will agree that the state of roads around here are beyond fvcked.

        They can deny it because it's modified , most aftermarket suspension manufactures state they're for off road use only. (still can be legal via ATSA ) they City is a huge target for having claims against them all the time for false claims. Not saying yours is just don't be surprised if it doesn't go in your favour in the end . Good luck tho.

          So far the argument I'm having has nothing to do with the condition of my car at the time. He doesn't believe that the city was aware of the issue at all when it happened. It's hard to convince someone when they have clearly not even looked at the pictures you send.

                Heavy downpour, manhole covers and even covers with sleeves popping out of the road. Heavy traffic, couldn't avoid one and tried straddling it. Shattered my tranny's oil pan. Call the City's claim department and asked what was required to make a claim. Followed through with it and all they wanted as far as quotes, location etc. They didn't question whether my vehicle was lowered or modified. If I really wanted to fight with lawyers and months of B.S. I had a pretty strong case, but yeah they pretty much bent me over and screwed me dry (for lack of better words) Spent the $1400+ in damages and repaired my car

                  I'm sorry guys, but I still don't see how the City is responsible for the ground freezing and expanding due to cold, or sudden changes to road conditions during a heavy downpour. Responsible for negligence, sure, but for natural events? Nope.

                    I think at this point its the fact that the signage was not properly displayed and thus didnt give drivers any warning as to what was ahead.

                    It's like saying that they're not liable for giant potholes because it naturally sunk down... If this were the case they wouldn't bother repairing any roads.

                      So you drive for the conditions, I agree with Jeff. The responsibility rests with the driver of the vehicle to operate it in a safe manner, as far as I can see this is the equivalent of driving too fast in a rainstorm and hydroplaning and trying to blame the city for not putting out signs. I drove that road and Crowchild trail during that time, while the heaves were annoying, they didn't cause any damage to my car because I saw them and slowed down. Frost heaves and potholes are a common occurrence during these times and you have to be prepared for them.
