  • Making a damage claim with the City of Calgary

    Today as I was driving to work I took John Laurie (not my usual way) and came across giant frost heaves in the road. Needless to say, I bottomed out, hard. Twice in fact since there are two heaves in a row. Oil pan is cracked (again) so I am getting it towed to Calgary Autoworks to get fixed, and get some other things fixed while it's there.

    I called 311 as soon as I got to work and verified something broke to start some sort of claim, my justification is 1. Something broke on public road due to road condition and 2. There are no signs or warnings.

    I'm posting this up to see if anyone has tried submitting a damage claim to the city and got the repairs covered. Or if anyone has advice / previous experience with this.

    This is where it happened (I think) or at least close to

    I've never had experience with a claim like this, but do you have any pictures of the frost heaves?

    I'm assuming your car is lowered and they might just say since you are lowered they would just deny your claim on the spot, but I could be wrong

      I did this a few years back when I had wheel/tire damage from a huge gap in the road that had no signage, best thing to do is go and take some photos of where the damage took place, it will help support your claim, also since you are having work done on the car make sure to send in the invoice as well.

        Tell them to install a hybrid or steel pan assuming you drive a 1.8t. I went through 3 aluminum pans within a year with a factory steel skid plate lol. So I definitely know how you feel, good luck claiming, John Laurie is full of traps so it shouldn't be too difficult to claim with enough pictures taken.

          I tried to get the city to pay for my wheel repair from hitting a pothole. The city said that since the pothole was not reported prior to me damaging my wheel they were not liable. BS if you ask me.

            They will do all they can to avoid paying. There's signage there already as well... it's been there for months. I'm willing to bet that puts them in the clear.

            I made a claim in Edmonton after losing a tire to this monstrosity.



            I included all receipts and a file number proving that I reported it to the city. Also attached pics and a witness statement from another young gentlemen who had a flat when I went back to take pics.

            Still, the city told me that it was a provincial construction zone and that I'd have to contact the construction company directly. This is after waiting a couple months for a response.

              same thing happened to me, they said since they had no prior knowledge of the hole there was nothing they could do... essentially means that if you are the first person to report road damage you are screwed.

                Henday to Yellowhead out to sherwood park?? If so that road is deadly.

                And that is Alberta Transportation highway, none of the Henday is owned by Edmonton.

                  So what I am gathering from this thread is the only way you have a hope in hell is if you make a detailed claim to the proper authority between the time of the first report and when signs go up as that is the only time there seems to be any liability.

                    The city will only be liable when they know of a problem but haven't fixed it yet. So if someone was to anonymously report the problem then a short time later you were to report your claim, you should be covered.

                      Yep. And then hope the city doesn't lie and tell you the problem was not reported prior to making your claim.

                        It's getting unsafe for lowered cars right now. I keep bottoming out on stoney trail thanks to all the heaves, and that's slowing down to 40 to take them. Country hills off of deerfoot is terrible too.

                        At least signage is slowly being erected.

                          Deerfoot at stony trail (old 22x) southbound has some Huge frost heaves .. Signs slow you down to 70k .

                            From what I've seen so far, the city is going to run out of bump signs......

                            Give a call, might not hurt to have someone else call too and report it.

                              There's a fairly big one on 17th right beside the old children's hospital. Definitely would've caused some problems if I had been in the GTI. There's another one that recently popped up on the Heritage connector from NB Deerfoot to WB Glenmore right at the Burnco entrance, but that one isn't too bad yet.
