okay.... so long story short my brother and i are both in Edmonton for the week, the car he is driving used to be mine and is still registered under my name, he got a traffic ticket for going through a yellow light.... i don't understand that but thats beside the point, heres the kicker... the officer put my name on the ticket and i wasn't even in the car, i suppose he saw my name on the registration and just assumed but that does not change the fact that i was not driving nor was i near the car, so my question is what can be done about this, can he just go to court and fight it or is he going to need to come back up here for the court date and get it settled?

you will have to dispute. just be able to prove you were not driving the car at the time. receipts putting you in a different city at the time should suffice.

I can put you in touch with a guy in edmonton that is amazing at fighting tickets and could do it on your behalf in edmonton, you wouldnt even need to be here, and his rates are ridiculusly reasonable compared to what the other agencies charge. He found a loophole and got a photo ticket in edson thrown out for me, and they hang on those like grim death cause alot of that towns revenue comes from photo tickets.

i've been to court to fight a few tickets. the story you have is very similar to most of the trails i witnessed. now, that's good and bad. bad because most of them are liars and trying to get off. not saying that you are, just be prepared. and this is what you'll have to be prepared for...
the judge's first question will be "do you know who was driving the car?"
the second question will be "we will reschedule, can you bring him in? if you don't show up then you will be charged from your absence."
if you don't know who was driving the car, then the judge simply won't beleive anything u say and convict you on the spot. but it does sound like you know who it is .. so be honest and your bro will get the ticket.
your bro may also get a ticket for the registration being invalid. depends on what kind of mood the judge is in. just be honest

Is the insurance and the registration both in your name? If so the cop wrote the ticket wrong and should be thrown out. If the registration is in your name and the insurance is in your brothers you can just say you just sold him the car as you have 14 days to change it.Name: Brent

the only way the ticket will be dropped is if his car was stolen, declared stolen, and he didn't know who the driver was. but because he openly admitted to knowing who the driver was, the judge will ask him to be brought in and he will be issued the ticket.
soon as you say "it wasn't me but i know who it was", then the offence still stands. the only thing that changes is the person who has to defend themself. the officer did witness and issue a ticket.
you would think that an error on the ticket of that calliber would be "thrown out", but rarely have i seen that happen. it's usually incorrent dates, descriptions or unreadable writing that gets rid of tickets.
the loop-hole they use is the redlight camera approach. if you get a ticket and say it wasn't you driving, they don't care. either bring the driver in, show a police report stating your vehicle was stolen, or you pay the ticket

went to try and talk to a judge so we dont have to go back up to the horrible city again , but no such luck they send us to police headquarters in edmonton to see if we could speak with the officer that issued the ticket, he was not in, the officer that was helping us called the guy and told him it was his choice they can either void the ticket then and there or make us come back and fight it in court, welll guess what.... we have a courtdate in may, the officer there said that the ticket should get thrown out becouse of an error that big so i hope it just does and they dont just transfer names... il make sure to go up with my brother, who admits it was him driving becouse he was and hopefully the ticket just get voided, it was a yellow light violation ticket too my brother was waiting the turn left at a light so he was in the intersection which by my understanding might not be the correct thing to do according to the books but every one does it, light turns yellow so my brother goes through insted of bloking the intersection and got a ticket for that (cop said he run a red) I dont know exactly what the books say about that but i see every one do including my self and cops soo its hard to belive that he would issue a ticket for that, maybe he was having a bad day.
