  • AMVIC facts...I need them. Dispute over purchase!!

    Hey fellas,

I had purchased a 2007 Mitsubishi Eclipse Spyder GT-P from Crowfoot Hyundai a couple of weeks ago. There were some concerns after the first weekend of ownership that made me upset after spending $19,000 on a three year old car. Don't get me wrong, the car is fun and quick, but for $19,000 on a newish car, I expect the vehicle to be in correct working order.

But it wasn't. I'll get to that a little later. First I would like to tell everyone of my experience with them. When my wife and I were looking at the car, we liked it. Test drove it around a little and liked it. It was during the start of rush hour and couldn't really bag on it, but could tell it had some go, just from the torque the 3.8L had from city driving. I told the salesman that if my other choice, (which was a 2010 Hyundai Genesis 2.0T "track pac" from another Hyundai dealership), didn't work out because of my credit history, that this Mitsu will be the way to go. He then wanted a $500.00 deposit on the spot to hold the car. I was just about to sign the paper and then I read non-refundable on approval. So I lifted the pen farther away from the "contract" and said "will I still get my $500 back if the Genesis works out?" And he said NO. Very sneaky! And shady. He knew that this was a plan B option. I should've walked away right there and never went back. But the wife really wanted this car and as the old saying goes...a happy wife, a happy life. So being newly wed for only a month, I listened to the old mans advice. The Genesis wasn't going to work out for our monthly budget because of the high interest loan, so we decided to purchase the Mitsu.

We went back to look at the car again. I noticed that the handbrake went fully extened when applying it and requested that be adjusted. No problem he said(salesman). I also asked if the car had a spare key to go along with it and was told yes...two keys. He mentioned that this will all be done before we picked up the car a few days later. We went to pick up the car which was a scheduled appointment for 4:00pm on a wednesday. We ended up waiting for one hour before the finiancial clerk was ready to do the signing portion of the deal. He was so out of it, he ended up shredding a small tree because of all the mistakes he was making on the contract bill of sale and the finiancing contract. It was so tedious.

We finally finish with all the paper work and he hands me the "keys"(2), and mentions that they didn't get around to getting the car fixed but to come back at a later date and it will be done for no charge. I then look at the keys and one is cut for the car while the other is not cut at all, or programmed to the car. I said what the hell is this? He looked as if he was surprised and said thats weird. But that Mitsu charges very little to get that key cut. And what about the programming I said. They said that since its part of the Hyatt group, they'll see if they can get me a deal. What A joke.

This is just the beginning of this mess. Very unproffessoinal so far. I'll skip through some of the other details but want to say that while driving through the mountains the first weekend of having it, I noticed that the front rotors were warped under braking at speeds of 110kms plus. And not only that but noticed that all four tires were severly cracked on the tread portion of each tire, but not on the sidewalls. Being a tech myself and inspecting numerous vehicles in the past, I knew that this shouldn't have passed an inspection. Called them up and complained to the used car manager. He said that the warped rotos are not a safety issue and neither are the tires. He did say that he'll pay for one rotor to be machined if I pay for the other one. I then asked how much this will cost me and he replied, 75 dollars. I suggested for that price why not replace the rotors with new. It can't be that much more. So he ended our conversation so that he could get a price from the Mitsu dealer. Calls back and says that they are 175 ea. I laughed and said parts and labour? iIn which he replied...just parts. I told him that I am going to confirm this and let him go. It turns out that the rotors are only 109 ea from the dealer. I tried to call him back and low and behold, he was in a meeting. I then asked to talk to the General Manager after just being lied too and the receptionist said he is both the used car manager and the general manager of that dealership. Go figure!!

So I let it go and waited for a few days to pass while I cooled down. So I called up the dealership again and was re-directed to the service manager. He said that they rotors will be getting machined for free and to come in to get the other discussed items done at no charge, besides the key getting cut and tires being replaced. I will admit that the service manager was good **** and was easy to deal with. Perhaps he should give a lesson to the General manager in customer service. I said forget about the key, that I just wanted the tires replaced due to the severe cracking on the tread. He took a few pictures and e-mailed them to the used car manager. Picked up the car later that day and it was good. He then told me that the tires were not a safety issue and will not be getting replaced, but said the used car manager was willing to work out a deal. He said that he will buy two tires if I bought the other two for a total price (get this) of $1500 bucks. I just laughed in his face. There is no way the tires are costing him half of that. I been in this dealership business for 5 years and know how this works. They'll end up maybe paying 200 in the end while I'll pay 750. I then left and called the manager up the next day. I said how about you transfer 750 to Urban X and I'll get my tires there. Of course he said no and proceeded to argue again that this was out of the goodness of his heart and was not obligated to even pay for two tires. I then called him on his strategy and that I knew what he was doing and expressed to him that I have been working in the dealership industry for 5 years and know the ins and outs. Then he, the general manager of a dealership calls me "dude". I paused and said to him..did you just call me "dude"? He then paused and said he was really sorry. Ya right.

So i had filed an AMVIC complaint against them but still haven't heard back yet. But was wondering if anyone knew for sure that cracking on the tread portion of the tire would fail an inspection. I know for a fact that as of June 1st, 2010 all AMVIC vehicles must be inspected using the new form issued on June 1st even if the car was inspected may 20th 2010. So they are already in the wrong on that. Whats your opinion? I know that I will fail any vehicle/tire if I see cracking on any of the rubber. And this is "Our dealerships" standard which cost them money to replace them. I can't wait to hear from AMVIC on this. I'm sure the tires would fail in ther eyes too.

On top of everything, you've taken the time to do so far, I would look to see if that dealer is a member of the Better Business Beaureau...and file a complaint with them as well...I've had success with the BBB in the past...due to improper business dealings. good luck!

man that sucks, props on writing such a long post though, I enjoyed reading it. Did you by chance mention to the dealer that you would be calling AMVIC, i've found as soon as you mention AMVIC stuff starts happening in your favor. when I was looking at a car a couple years ago I was having problems with the vehicle history, so I was just doing some background work on the car and found the used car dealership the car was purchased at by the PO a year or so earlier and got the run around from them giving me some BS that they hold all their files in a giant warehouse blah blah blah and wouldn't give me the documents if they had them anyways, so on my way out I mentioned that it would be a shame to have to call AMVIC over something so small, haha, 5 mins later as I was driving home I got a call saying they had the paper work and would fax it to me.

        Hope it works out

              My .02 cents..
If the tires are cracking that's an automatic fail they can throw a tread.
Amvic will generally side with the dealer and not the tech that inspected it.
It's always the techs fault.Iwould ask for the inspection report and make sure it was'nt signed off by the detail guy.
As for the BBB it's a waste of time.
Ask for the report and who signed off on it.

Sounds like the same salesman...LOL. I think I mentioned to them that I will be contacting AMVIC, but maybe this time, I'll ask for the technicians licence number to spark a little terror so that they realize I can't be swept under the carpet. Thanks for your advive man

Well...filed a complaint with AMVIC and faxed over all of the relative documents that they needed to see including the old inspection form and it even has a check mark beside the heading "Tread Section" keeping in mind that there is another heading named "Tread depth". Completely different things to be aware of. My case was assigned to an investigator on Monday and I should be recieving a letter soon as too the name and contact info of the investigator. I believe that they contact the dealership first to get there side of the story and try to rectify the situation before I hear from the case worker. Stay tuned.....
