Challenge bylaw ticket after conviction

Hey cats. I just got a letter in the mail that blew my mind. It says i was convicted of a charge in my absence. It's only $70 but it doesn't make any sense.. The "Act & Charge" reads "Municipal Bylaw Conduct Srevice Or Repair On S"

And i've never received a bylaw ticket that matches this. I had a parking ticket from my office, but that came last week.

So how can something go to court without my knowledge? And what can I do about it now? It's the principal that i'm angry about. I have to deal with so much corporate tax $hit due to the government's mentally challenged employees anyway. So now this is just another gigantic flaw I see in the system.

Sometimes it'd be easier to be a sheep like the majority of population and not recognize this crap.

If it really says "srevice" then its probably the Nigerian Bylaw Ticket Scam...don't pay it :-)

Looks like service or repair on street...That means fixing a car on the street, I assume.

that's what i'm thinking. so one day i changed my spark plugs in front of my house. wouldn't they have to give me a ticket for that? instead of it just going to court and charging me $70... how can they prove it was even me

It's stupid, but it is a bylaw. What could have happened is that a neighbour complained and they issued a ticket at that point. It is your prerogative to go to court to fight it. It's like a citizens arrest...sorta...

At least thats how traffic ticket work also. You can complain about a driver to the police, they issue a ticket and then they have to go to court to fight it. In this case, whoever made the complaint had their statement taken by an officer and on the court day they are also obligated to show up as a witness.

Actually I think you would be hard pressed to find a city in north america that doesn't have some sort of law against this. When you think about it, it actually makes perfect sense. Risking fluids draining into city water systems, damaged caused by oil based products which break down the road surface, safety of individual working on a car where their is traffic, etc etc the list goes on. Basically the city has to reduce the safety and environmental impact where it can, and it just so happens the street belongs to them so they should be doing everything they can to enforce these laws.

C-tire actually has signs in their parking lots and in the automotive section of every store i've been in stating any sort of repairs are prohibited in their parking lots. Also if you are caught working on your car in most condo complexes you can be fined or evicted.

If you go to court to fight it. Does not the city have to 'prove'n and provide evidence...? If so is there a freedom of information act or equivalent where you can ask for the evidence against you?

Oh yeah, the other person has to show up and give evidence. But in Canada, you have to prove your innocence. You are guilty until proven innocent, if I remember correctly.

So, this is the by-law that you were violating:

"Except in the case of a breakdown or other emergency not allowing the vehicle to be moved the owner or operator of any vehicle shall not stand or park it on the street for the purpose of servicing or repairing the vehicle."

You should call 311 I am pretty sure that they can answer the question of What the "F" do I do now. Seeing as they handle all bylaw issues.

I also found this for Edmonton...pretty sure Calgary works the same way.

"Within 15 days of receiving a bylaw ticket, a 'final notice' is mailed to the registered owner of the vehicle if the voluntary payment is not made by the due date.

After 45 days, a 'violation ticket' is created for processing. This ticket will have the required court appearance date printed on it. Failure to attend court may result in a conviction in absence'. Please be aware that additional penalties and motor vehicle services denial may be put into effect until all fines and penalties are paid.

If you wish to appeal a Bylaw Ticket, you must contact the Bylaw Ticket Administration office. Violations may be appealed within 15 calendar days from the date that the ticket was issued by writing a letter of explanation and appeal..."

i'd go to court and try and fight it. through discovery you should be able to determine which ******* neighbor called the cops
