    Not my self personally, but a close family member is currently in the process of doing so. Did you get hit?

        I got sued for personal damages for a small rear ending years ago.. dont remember what she got from me..

          Ha everybody get ready they just announced insurance rates are going up 40%.
          That soft tissue damage B.S got thrown out you can now Sue for whatever you can get.

            Soft tissue is now back in with a 4.5k cap now. We are still going to get jacked though,

                Despite recent headlines that major insurance industry players would be looking for 40 per cent hikes on basic premiums starting Nov. 1, there was no discussion of dramatic increases at the Automobile Insurance Rate Board hearings that started Tuesday.

                At least two insurance companies said they would not seek any increases at all for basic insurance coverage.

                "With the decision from the Alberta Court of Appeal, we've taken a quick look at what our rates are . . . and we think we'll have adequate rates . . . if they say no increase," said Robert Katzell of AMA Insurance.

                On Friday, the appeal court released a ruling that permits a $4,000 cap on payouts for minor soft-tissue injuries.

                The Insurance Bureau of Canada had recently argued that a nearly 40 per cent increase on basic insurance premiums would be needed if the appeal court ruled the cap was unconstitutional.

                The national insurance industry lobby now says it will seek a 6.4 per cent increase when it presents to the rate board this morning.

                "We had to do a little bit of a shift," said Jim Rivait, Alberta vice-president of the of Insurance Bureau of Canada. "We know that consumers want to have lower premiums and taking that 40 per cent off the table, although we still have a margin of uncertainty, we think that's the right thing to do."

                It's still not known whether lawyers for injury victims will try to take the case to the Supreme Court of Canada.

                But representatives of the Alberta Civil Trial Lawyers Association told the rate board that car insurance companies do not deserve any increase.

                "Insurance companies are making profits well beyond what they expected," said Rick Mallett, a past-president of the lawyers association. "Their return on equity is in excess of 20 per cent, which is a very healthy return."

                Mallett noted that the rate board's own target for such profits for insurance companies is about 12 per cent.

                The rate board's own actuary, Ted Zubulake from the firm Oliver Wyman, said that with a cap in place, mandatory insurance rates should go down three per cent.

                The board must release a decision by Aug. 1 on basic auto insurance premiums for next year.
