  • Alberta Sheriff's question pertaining to a ticket

Ok, here's what went down! Danielle was pulled over today for 74 in a 60 by a Sheriff. While pulled over, she went to grab her insurance and registration, and was unable to find her pink insurance card, it was not with her registration (which she produced). Long story short, she got written up for failure to produce valid insurance.....She discussed with the officer the following which did nothing:

She renewed her registration 2 weeks ago, the day her car was stolen. She needs valid insurance to register her car, and our policy regardless is good till april 08....

During her car being stolen, it may be likely the pink card didn't get returned by the officer dealing with the theft by accident, or may have been lost as her glove box was ripped off (and still is!!)

Now, it was my understanding you have 48 hours or so to produce valid insurance, am I wrong? We have 6 extra pink cards sitting at home at any given time incase one is lost or so, and its reasonable to assume with the history of that car in the last while that human error has occured, resulting in a misplaced card. She was given NO option to prove valid insurance at any point, and simply given the fine.

Does anyone on here know any of this info I'm looking for????

    1. Is there a grace period to prove insurance (pink card dates cover without a question)

    2. How the heck do I get ahold of the sheriffs department?? Do they have an office?? No contact info on the ticket...

    3. Is the best bet to goto court with the above documents and plead her case (a truly unfortunate one, poor girl has had nothing good happen this month)?

    Thanks....

Talk to crown prossecutor as per a speeding ticket? The guys in Calgary are really nice guys. For people who really have misfortune they are almost glad to help, its something nice they can do for a change instead of arguing with drug dealers and crap like that.

Just chatted with my bro about this. First off, you need to have proof of insurance at the time, so therefore the ticket for insurance is valid.

With that said, Kris is bang on about talking with the crown prosecutor. Given the circumstances, there is a good chance they should let you off.

So talking to the crown prosecutor is appearing in court, correct? I've never fought a ticket before, never had to because hey, I was guilty! I do believe this was total nitpicking though.....I won't go into a sheriff rant

edit: courts in airdrie for this one

I thought you could go down and talk to someone before your court date, or is that jsut for speeding fines?

There was already a long heated discussion on this topic:

I don't know how it changes for a sheriff though.

Yeah, I'm aware of the procedure for CPS, thats simple, but I have no idea where sheriffs are based out of, where you can address concerns, etc...

Talking to the prosecutor isn't really the same as court. You can go anytime after 1 week after getting your ticket... you just visit him in his office and have a discussion.

There is no way you can otherwise undo a ticket, once its been issued to you, you are stuck with it... the Sherrif won't care.
